Now, don’t worry if this site, shopimar.net and shopimar.com, have been a work in progress since 2008, eventually it will get interesting.

Btw, if you are a merchant reading this don’t be afraid to get ideas from this TOS and add one to your program. When I added this similar sample TOS on this page http://www.jrami.com/category/merchants/sample-tos/ it ‘WAS’ the idea, that merchants just like you would find it and implement a similar one to their store, network and affiliate program. No matter how much info or little info you add to yours or how you make your own affiliate program TOS, (you may also want double check with your own attorney if you prefer to make sure you have your own proper TOS wording incase), just please have one ready for your partners when they join, update everyone everywhere with any revisions and that all partners can find it easily at any time. Your affiliates and partners will appreciate it, trust me.

Affiliate Terms Of Service Agreement (TOS) for KelleyFurniture.com through ShareAsale.com

To sign up as a new affiliate partner at any time or if you are a current affiliate partner now promoting or going to promote KelleyFurniture.com at any time within ShareASale.com, please verify that your store(s), blog(s), websites(s), forum(s), third party sites or partner sites, third party advertising sites or locations or any location from where you will be sending KelleyFurniture.com traffic, sales and leads and adding coupons, links, banners and datafeed products, please verify any of the listed “concerns” below.
Periodically we may monitor your store(s), blog(s), websites(s), forum(s), third party sites or partner sites, third party advertising sites or locations or any location from where you will be sending KelleyFurniture.com traffic, sales and leads and adding coupons, links, banners and datafeed products and we will update you direct or all partners at the same time with a friendly reminder of any concerns or of our Terms Of Service or TOS.
Criteria:
Our criteria for approving any affiliate or continued relationship with any affiliate partner or partners at any time, is that all sites and places where our banners, links, coupons, datafeed, products or product images are displayed or promoted, must be in English or Spanish only, even through the use of email, blogs, forums or other locations, whether you use your own domains, third party domains or our own domains and sites that we may provide to you or your own domains, sites, blogs or forums for any promotion, is that they be kept free of errors on your end when an end user or consumer visits or from any affiliations with other sites that may promote and use technology software, parasitic activity, inappropriate browser helper objects, redirecting toolbars, illegal activities, hatred or porn, etc.
Concerns:
Concerns that may cause temporary removal or permanent removal from program and your commission possibly set to a 0% (zero percent) while the concern is remedied or permanent.
A – verify that the site does not have a “‘no page found”, “wrong page found” or any error message showing when any end user visits or clicks-through
B – verify that the site has no inappropriate content such as porn, hatred, illegal or offensive material
C – verify that the site is not in another language other than English or Spanish
D - verify that the site does not have a URL or domain redirect, IFrame or forwarding to another site not approved by us or a competing site or store no associated or partnered with KelleyFurniture.com
E – verify that you have appropriate contact name and email listed for you under your affiliate shareasale.com account in order for us to reach you for concerns and updates
F - verify that your site has no parasitic activity, too many pop-ups or any automatic downloadable software. Note: download software such as those within a banner or link from desktop supported technology companies, incentive type sites, auto download toolbars, adware, spyware or variations thereof that may redirect affiliates, end users or consumers improperly and that may delete affiliate or network tracking codes or cookies from any of our partner affiliates, sites, sister stores, shareasale.com or other networks and their tracking, will not be approved to promote KelleyFurniture.com at any time.
G – verify that our datafeed or products are not included, uploaded, downloaded or advertised directly by you on places such as eBay, Yahoo, Froogle, (Google Products Listing ), a competing merchant site(s) or store(s), etc or similar locations by you as an affiliate partner, as an associate or partner as an affiliate link, banner, domain, page, or a redirect, other than on your own affiliate sites(s) and domains that may conflict with any of our own stores, networks, third party partners or other approved partner sites or affiliate partner stores and sites.
Trademark:
Effective February 1, 2010 Revised PPC (Pay Per Click) and use of Trademark/Tradename Restrictions and Terms for KelleyFurniture.com
1) You are allowed to use direct-to-merchant (DTM) advertising at any time through Adwords, Yahoo, Bing (MSN) or similar third party advertising sites to promote KelleyFurniture.com using any variation of keywords found throughout KelleyFurniture.com from our categories, descriptions or product pages.
2) You are not allowed to use direct-to-merchant (DTM) advertising through Adwords, Yahoo, Bing (MSN) or similar third party advertising sites that contain our tradename KelleyFurniture.com, KelleyFurniture or Kelley Furniture in any Ad whereby KelleyFurniture.com, KelleyFurniture or Kelley Furniture shows or is visible in the Ad URL, Description or Title.
3) You are not allowed to use the word official or a ‘TM’ symbol in Adwords, Yahoo, Bing (MSN) or similar third party advertising sites that contain our tradename KelleyFurniture.com, KelleyFurniture or Kelley Furniture in any Ad whereby KelleyFurniture.com, KelleyFurniture or Kelley Furniture shows or is visible in the Ad URL, Description or Title.
4) The end user or consumer must eventually link to or click-through from within your site to any of our KelleyFurniture.com product pages or the KelleyFurniture.com home page for your affiliate promotion of KelleyFurniture.com when using Ad campaigns such as Adwords, Yahoo, Bing (MSN) or similar third party advertising sites.
This TOS may occasionally be updated and sent to you direct or to all partners at the same time via email or updated on our sites, networks, forums as we make revisions and as a reminder. However, you are responsible to find and read this TOS from time to time to update yourself and be in compliance of this TOS. We monitor activity, tracking and url sources often and those in violations we may decline, set commission to 0% (zero), suspend and remove from our program for noncompliance and any inappropriate an unfair methods, campaigns or practices that hurt any other affiliate promoting KelleyFurniture.com of any our other sister stores or partner sites.
